45 degree rule

My neighbour plans to build on his exsisting extension. Our house is set back futher from his and the extension will be obtrusive, and cast a shadow over our house and garden. Our main bedroom is at the back and from our window the 45 degree angle stops at their current downpipe. This means the planned extension will go over 12 and 3 quarters feet past the 45 degree line. Will he get permission? :confused:

Hello.

Contact your local authority confidentially to describe the circumstance and obtain a view from the planner and buildings regs officer. There will be a planning officer looking at any planning application so speak to them about it. If its built, a planner might require it to be taken down so perhaps your neighbour has yet to understand the permission and regulations?

The so called '45° rule' is not statutory. Some local authorities follow it slavishly and others use it as supplementary guidance. I would look on the LA website and see if the rule comes up in planning guidance documents. If it does there is more chance that they might treat it as material.

If a planning application is made you will have the opportunity to comment and at that point the planning officer will consider your objection. Of course that assumes planning permission is needed and the building does not fall within permitted dvelopment.

PS. Don't get confused between planning permission and building regulations. This has nothing to do with the latter.
