Another Party Wall Act Question

Hi Everyone,

First time poster, and seeing how complex simple building projects can be, Im sure many more to follow!

I am basically extending 3m to the rear, my mid-terract 2-bed house.

I am trying to understand the PWA. Section 6 3-Metre rule will not apply as I am not going deeper than the existing foundation.

However, I am a little confused on the 6m rules which says (as I understand it)that if
1) you were to draw a vertical line into the ground from the bottom of my new foundation
2) and a line at 45 degrees from any point of the neighbouring property from their ground level

3) and they intersect, then the PWA applies.

But surely, any 45 degree line and a vertical line will ALWAYS intersect at some point, as they form a triangle in effect. So what am I missing here? Why not just say if it's within 6metres, the PWA applies FULL STOP?

Also, when it says measured "horizontally" does it mean "along the ground" or does it mean parallel to the existing walls? I ask because if you look at the side elevation of my house, it already goes more deeper into my garden than any of the other adjoining properties by about 1m. So side elevation, there is no wall in my line of sight. However, if I was to stand at a "diagonal elevation", I can easily see other walls within 3metres.

Sorry for the detail above, but I hope Im managing to get my point across!

In terms of the 45° rule, this would come into play if say you were 4m away and your foundations were more than 4m deep, or 5m deep for 5m away etc

Horizontal means in a horizontal plane in any direction, measured from the edge of the neighbours foundation and not their wall
