Building Regs-window cill height

This is in relation to my extension. The original windows of the existing house are about 650mm above the floor so I would like the new ones in the extension to match.

I've read that BR state that windows must be a minimum of 800mm above the floor. Is there any way around this or is it a hard and fast with no get out options?

K2 - Protection from falling Where a first floor window sill height is less than 800mm above the floor level suitable guarding should be provided to prevent a person falling through an open window. This requirement may conflict with Regulation B1 and provision of escape windows. One way of achieving the requirement may be to provide a restricted opening device that can be easily overridden in the event of an emergency.

So would a 'stay' be considered appropriate as a measure to restrict opening but be easily overriden?
 
Or one could discuss with their BCO and try and convince them on the basis that the new window will be no worse than the existing and see if they are accommodating or not.

But it will be a completely newly formed opening and window ie in a newly built extension.

Is it still worth me trying to convince them as you mentioned? ie that the older existing windows are 650mm off the ground.

I've spec'd child restraint latches/catches on jobs with low sills, as TheVictorian suggested. The BCO should be able to advise further.
