CAT III eqipmentin bathrooms

Has there been any new legislation on CAT III equipment in bathrooms? My mate is trying to rent his house out and his NECEIC test has come back failed because of a lack of CAT III equipment in his bathroom. The lights are not above the shower or bath and they are CAT II and enclosed.

It should say on the report what has actually failed the inspection.

Is there a mains voltage fan over shower or bath? This should be SELV.
 
If the equipment doesn't incorporate a switch or other means of electrical control or adjustment, then it is allowed to be accessible from a bath or shower, including 230v equipment. So cat II should be allowed above a bath or shower as long as it is IPx4 or above. Is it possibly a case of an NICEIC electrician getting it wrong? There are no lights above the bath or shower, and the fan is above the toilet in zone 3.
