Chimney needling inspected / swept?

Hi, we're due to move house in the next couple of months, with the new house having an open fire in the living room. We've asked about the state of the fire (last time chimney was swept? is it lined? etc) to current owners but getting vague responses.

The house is only 10 years old and was constructed as part of a larger development. My question is: what were the building regs that were applicable at the time that it was built? We're regulations regarding the chimney lining at that time such that I shouldn't be concerned about using this fire without it being inspected first?

There is a cover over the top of the chimney pot (a wire cone - don't know what the proper name is for this!) which presumably is to stop bird etc from falling down the chimney.

Any help / advice would be appreciated, should I labour this point further with the current owners as clearly my knowledge of chimneys is limited to the sweeps in Mary Poppins!

It probably should be swept annually anyway. So why not get it swept when you move in and when booking the sweep ask if they can give you a report on the state of the chimney.
