On a slightly different subject and just curious, but why would someone not just get standard downlights with twin and earth rather than class 2 downlights and tape up the earth like this?
A circuit protective conductor shall be run to and terminated at each point in wiring and at each accessory except a lampholder having no exposed-conductive-parts and suspended from such a point.
I would not consider that earth as being terminated, maybe non British rules are different, but I have said a few times, there is a problem with installed class II equipment where often a parking terminal for the earth is not provided.
Many items there is a parking terminal for the earth, wall thermostats for example.
I suppose the next question would be if you could do a straight swap for new downlights ( not class 2) using the existing wiring and utilise the existing earth?
