Currys refused to take back faulty TV

Hi guys, sorry if this is not the right place for this issue but...

I purchased a TV yesterday from Currys. While the tv was on I noticed some intermittent flickering. I packed the TV back up including all its accessories etc popped back into the store today and the store refused to take it back as they could not find a fault with it. And, that was a manager who said that.

Where do I stand and what can I do?

where is the tv now
if its at home take pictures or videos off the problem
dont be fobbed off if they try and tell you to contact the manufacturer direct as its there responcibillity as you dont have a contract with the manufacturer only currys
 
We had this exact same problem, I spent about 4 weeks looking round for TVs (found the one I wanted), waited til Easter weekend and watched prices drop, I was all set on Samsung got into currys anyway I'm not easily persuaded but 4 hours later guy convinces me into a Sony (looked better picture in store) Bought it, got it home, unpacked, was slow as anything and kept loading, picture awful etc etc never had any probs with previous Samsungs even when new, next day took it back (Easter Monday) girl behind counter had a right attitude refused to refund so off they go plugged it in, guy testing then says we have no tv Ariel to test we only have playback chips or whatever they use so I says well it doesn't work, they then say you will have to phone Sony to get a ref number for the fault and they can refund then, so told the now manager that I bought the tele from them and not Sony to which she replies "it's not our tele we don't make them" after about an hour of arguing back and forth I literally hit the roof on bank holiday Monday at the desk, shout girlfriend who has had to walk off cos she's embarrassed, caused a right scene (I'm usually quite polite but the girl was an arrogant sh1t). manager then says ok we will swap so I politely tell her unless shes swapping for a Samsung she can shove her offer and I want a refund, literally another hour passes with all the fuss and they agree to a refund after I go on ranting about trading standards and they're a disgrace and I want the head office details etc etc
Got my refund and I still complained to head office and got a £100 gift card and bought my tv elsewhere just to spite them...had to pay more from John Lewis but it's the principle
Moral of the story, be polite until they refund, if they don't offer refund, kick up a fuss on a busy Saturday with a good audience!

I bought a 'x-hose' from Argos and after 6 months it came apart and leaked. When I brought it back to Argos they said they would have 2 take 6 months usage out of the refund. My reply was 'your having a f--king laugh'. The manager was called over and I was given a full refund.

Shout and shout loud!

Neighbour tells me he bought a 55" Panasonic from Currys and it failed after a month. They tell him it can't be repaired as it was a refurbished set. He says that was not pointed out when he bought it. Anyhow he got it swapped for a brand new one and got a £20 voucher.
 
Hi guys, sorry been busy at work. thank you for all your replies. I paid with credit card and complained to Lloyds. Hopefully they will pay me back via chargeback and get the money back from currys. Will keep you updated.

I will also contact Headoffice.
 
I ordered a Beko washing machine from Curry's online, they duly delivered it. Took one look and sent it back, drum was half the size of my old machine! They came and collected, full refund, no questions asked. Got Hotpoint in to fix the old machine, and they even put 12 months warranty on the whole machine after repairing it!

Bit different with the distance selling regulations (now called the consumer contracts regulations) though: they're obliged to accept you giving notice to cancel the contract within 14 days and you don't have to give a reason. Terms and conditions define who pays for returning the item

These days it can be worth going into store and deciding on the TV you want, then going out into the car park and placing the order (Paying, not reserving) online/over the phone. Distance selling regs apply to collected items because it relates to the formation of the contract being off premises
 
EBay do not recognize the distance selling Laws when one uses their EBay Sellers, ( sale of item at advertised price) and uphold any item that is quoted as not returnable.

they argue they are an Auction Site and exempt from the Distance Selling Law, despite a Seller selling an item at a fixed price, however in Germany the Law is that any product sold over Distance Selling must be returned if the customer so wishes which includes items that have been bid on by Auction ( there are minor exceptions)
 
My experience to that is a little different; generally Buy It Now, BIN w/ Best Offer and Classified listings where there is a fixed price are covered under DSR unless the item is not, such as perishable, a service completed before the 14 day timer expires, specially made to order or for a particular context..

Even if the seller states no returns, they have to accept return of an item listed with a fixed price and a few times I've got into disagreement with them about it and ebay CS have sided with me for distance selling reasons

Don't get into an argument with them. Have a brief read of the Sale of Goods Act, (latest edition can be found somewhere on line), pick a few clauses and dates.
Then try to get to the counter when there a lot of people milling around. Calmly state your complain and when they start to fob you off throw those clauses at them, you don't need to be precise just confident you seem to know what you are talking about. They won't have a clue if you are genuine but so long as you don't tell blatant lies or make clauses up and seem to know what you are talking about it should start them wondering. Its even better if the queue is building up behind you because when they ask you to step aside and talk about it so they can serve the customers you simply refuse with the answer, "When you have finished serving me to my satisfaction and in compliance with the laws of the Court then I will leave. Until then I have the right to remain at this counter and, unfortunately, these people will have to wait to be served."
So long as you remain calm, (you may speak in a voice that others can clearly hear), they have no legal right to eject you from their premises and certainly no right to even touch you for fear of assault. (Yes, just touching your elbow in a gesture leaves them open to a charge of assault).
The secret is to stay calm and confident.

If you talking about Currys I would have to agree.

I bought a projector TV from them about a year ago.

It developed a fault a few weeks later.

I was told over the phone to take it to a local store for testing and replacement.

When I got there I was kept waiting for a long time while they phoned head office.

The phone was then handed to me and I was informed that I had been given the wrong information.

The equipment would have to be returned to their distribution centre to be tested and only then would a replacement be dispatched for me to collect the following week.

When I didn't hear anything that following week I phoned their helpline many times only to be fobbed off until I eventually found out it had disappeared and they were going to carry out an investigation.

They couldn't or wouldn't tell me how long this investigation would take and it eventually became clear that they thought I had stolen it.

It was only when I made all this known on Twitter that I got my money back.

Because of this they offered me some discount off my next purchase, but I vowed there and then that would never deal with them again!
