Depth of hardcore for patio and paths

Hi we're having a new patio laid and are doing the digging out for it. What is the recommended depth for the MOT 1 I've been told both 50mm and 100mm from different people. The sub soil is clay, so it is quite heavy work digging out, can't get a digger in, so I don't want to go overboard but conversely I don't want to skimp on this layer. Is the same depth required for paths as for patios? The patio will either be sandstone or porcelain.
