Its a bent heat shield... hit something in the road. To be honest only you can tell if its rubbing, but you could just lay on the ground and bend it back so it doesn't rub.

Check to see if it has corroded around one of the bolts holding it in place.
If so, it can usually be repaired by using an oversize washer.
