gas safety cert problem

Does anyone know about a boiler flue going through a chimney void? Is it illegal? We have a combi boiler mounted on the gable wall with the flue going straight out through the wall. This was done about 4 years ago. We are trying to rent out the flat and have had a gas safety inspection done which has failed due to the overflow pipe being to long and not turned inwards to the wall. Is this correct? And he thinks the flue from the boiler is going straight through the chimney void to the outside wall. Any advice would be much appreciated!

As long as there are no joins, I don't see a problem. If there are any joints in the void then an inspection would be requited from January, and a CO alarm until then

It is good practice to do as he says

Having said all that, a LL certrificate is NOT a pass or fail. Some RGI's seem not to understand this. It should be issued regardless of any safety implications, with those accurately noted. The cert is simply a statement of the condition at the time of the inspection
 
Hi, thanks for the advice, not sure where to go from here. We are getting the pipe done this week so hopefully that will be ok, as for the flue, is there anything in writing anywhere that you know of to fight my corner? To be honest I think they are just trying to get extra work before giving us our insurance. Thanks for taking the time to answer.

We are getting home cover from them that covers boiler, central heating, drains and electrics etc. He says we will not get the insurance until we pass the inspection. Dont know if they are just trying to get extra work out of us. Thanks again for your time. I will ask them to show me the regulations.
 
it is technically a flue in a void as it cant be inspected it is AR, it could be covered in soot and rotting away, FGA will confirm that it isnt leaking NOW but cant tell us if it will leak tomorrow so AR all day long for me,

I see what you are saying Kirk, re the soot etc, but surely you only need to be able to inspect JOINTS in a void? Or am I wrong? By the same token, a cavity would be a void.
