It's common to blame government departments for carrying out instructions and laws from the government.

Is there any suggestion that some civil servant has invented a rule out of spite?

Nope, one would have thought that in unprecedented times and circumstances, HMRC might have thought to seek clarity from the government.

You'll remember he wouldn't allow the Chancellor to have his own advisers.
 
They probably just copied the rules for heath checkups that are currently treated as a benefit in kind. Silly though.
