We are having a new boiler fitted our house was built in 1938 so there is some lead piping from boiler to kitchen sink, plumber is saying its illegal to fit to this lead pipe is this correct?

Its unwise but not illegal if done correctly.

It cannot be soldered and has to be joined with a compression fitting designed for the purpose.

I have this feeling you are wanting to save money by not having it replaced.

Unless he is overcharging I think that you should be having it replaced!

Perfectly legal, maybe he just doesn't know how to do it.
As Tony said although not illegal, the lead is not healthy. You should consider having it replaced.
Or you might just forget ;)

I was saying unwise to cover any health issues but particularly that a fat lead pipe will soak up a lot of heat from the water compared with thin copper so replacing it will be more energy efficient as well as convenient in getting hot water to the tap quicker.
