just been made redundant after 20 years as custom care inspector (inspecting defects to new houses for 3 national house building companies)cause i.v got cancer..going to go self employed doing inspections...what do you think a fair hourly rate would be..inspections would normally take 1 to 4 hours.....john08

hi john,am i reading your post right?youve been made redundant because you have cancer?think that could?be illegal under the disabilities act,if so i think you should contact your local cab office.good luck going self employed in this time.
 
I know a big cmpany/nousing association down here who are not renwing a guys contract becuase they have too many on long term sick already..he is genuinely I'll..non of the 'bad back' *******s..in fact he is very I'll..

Ok they may not be able to lay him off if he is on the sick..so they do it the legal way and dont renew his contract..

There are some horrible people about.

Could YOU afford to employ people in todays climate? let alone those who are unfortunate enough to be unable to perform to a reasonable level. FFS be realistic.
 
Ill health is one of the only three valid reasons for laying someone off, the other two being incompetence and industrial misconduct.

Redundancy is valid only if there is a downturn in business and/or the role in which the person is employed ceases to exist.
 
Yes I could providing of course I had the work..which they do, and loads of it

However my point is the blatent way they are going about it, the guy has been with them for 4 years barely missed a day. Unfortunately they have the law behind them, they dont have to provide a reason...he is not stupid and knows the reason and also knows he cant to a thing about it

Its not about being realistic its about flouting the rules..he has has two months of SSP to go after they terminate him, they could have kept him and claimed that money back.

It stinks
 
If he is an independent contractor or short-term employee without a good benefits package it is up to him to arrange his own PHI.

He is neither John, he is (until the 31st) a log term employee on the books.

Not much of a reward for loyalty when there are other guys on the firms with appalling attendance records and very suseptable to monday morning fever
 
I have a vague recollection that if a person who is on sick leave loses his job, there are some odd rules about not being able to claim sickness benefit because the employer is supposed to continue with SSP, and not able to claim unemployment benefit because you are not fit for work.

I was long-term sick once (but had my own PHI and got no state benefits)

he may benefit from some specialist advice.

You cannot make somebody redundant for being sick, unless of course they are abusing the system and then they would be sacked.
Most companies however provide sick pay for a period, generally 6 to 12 months.
After this period has expired the employment of the individual is terminated and this is quite legal.
Check the employment agreement.

So an employer can lay somebody off after say 3 weeks on the sick?
And,

I did and the and the op said that he was made redundant because he has cancer.

Ps dont bother sending one of your sarcastic responses in a hurry I am just off out for the evening, probably catch up with you next year when I have nothing better to do.
