leaking bath tap from BandQ

Hi Guys

Hope you can help.
I have a Cooke & Lewis Opulent Freestanding Bath Shower Mixer from B and Q -

and it is leaking from the diverter valve when you push it down (tap mode).
When you pull it up (shower mode) it stops leaking.

Has anyone had these problems before?
any ideas on how to fix?
