Minimum transom height on internally beaded windows?

Hi,
Does anybody know for sure if it is correct that a non opening transom that is internally beaded has to be a minimum of 400mm?
The overall height of our bedroom bay window isnt a lot and the firm that we have had out have said that the minimum has to be 400mm. This will put the transom bar right at eye level and you will have to stoop slightly to see the horizon. The windows over look fields so it is particularly noticeable and makes you feel cramped.(we have mocked one up out of white paper)
We have been told that they have already made the frame (I don't know if this is blagging to put us under pressure even though we hadn't said to go ahead) They seem a decent firm and we would like to go with them but I just don't know what the score is with the transom height.
The windows that they are replacing are externally beaded and the transom is 300mm and looks in proportion.

no, transom height can be just about whatever height you like. normally you would set them at 1/3 of the overall height so a 900mm window would be at 270mm a 1200 window would be at 370mm etc (30mm for the cill)

unless you have a fire escape window underneath the transom then you need a clear opening of at least 450mm width and height and a minimum opening area of 0.3m2 which may push your transom height higher rather than lower best to discuss it with the firm but im highly sceptical of the claim that the windows have been made no-one makes window frames then wait for them to be fitted, they are made to order and you havent confirmed your order?
 
It may be that they're worried about openers vs floor area for ventilation regs, are you copying your existing windows as far as the transom height goes or is a complete re design?
 
If its a welded transom our minimum is 360 if mechanical probaly anything you like

For clarity, replacement windows do not need to be escape windows if they were not before, they must simply be no worse than before in respect of the openings if smaller than the 450x450. Same applies to the height: no worse than before if higher than the min height.
