I live in a rented property.

My neighbours dishwasher waste pipe is in my garden and think it centres the border. I dont share the drain with them and over winter there is a build up of sludge and it stinks.

Who is responsible and is it a health hazard to me and my 20 month boy who has just discovered the garden

1. Have you spoken to neighbour?
2. Are you absolutely sure about the legal border?
3. When did you discover this?

Dunno.

However, there are usually (not always) two drainage systems, rain water (from roofs & land drains, which goes into streams and rivers) and foul (from baths, bogs, dishwashers, etc., which goes to a sewage waste treatment plant). There are generally two sets of drains and manholes, the water suppliers may have plans.

The shared down pipe on the boundary is usually rain water; does it come from the roof gutters? Properties often share a rain water down pipe, but you don't want to share a soil pipe which your neighbour could block with nappies, fat, etc..

Putting dishwashers, Saniflo, sink, bath, etc. drains into the surface water is prohibited; if you have any local brooks carrying detergent foam and shredded toilet tissue, you'll see why. The water suppliers would not approve. I'd look at that first.

Complain to your landlord; if he does nothing to sort the problem, complain to environmental health.
