No wall between our loft space and next door!

Our house semi detached, circa 1870, has no dividing in the loft between us and next door should there be one to comply with current building regs or are we exempt with the house being old?

building regs only apply to any work you do not to existing structure that was there before the relevant regs came in to force.
Our roof space was like that too when e first moved in.

Might be an idea to ring your building insurance for advice, I'm thinking does it covered if the fire started in next door loft area into yours ? So which one of you claim for damaged ?
