party wall act.

my neighbour has recently removed a chimney breat from an upstairs bedroom. The first i knew about it was when the constant banging started. The following day i went out to work glad to get away from the noise. I returned from work to find big cracks in my lounge wall. (directly below the chimney breast.) and the bedroom that joins the chimney breast has lining paper on it but when tapping on the wall it sound like the plaster has blown, and my neighbour still banging away I notified my neighbour of this he had a look at my wall but did not say much other than he had another day work and would look at the wall again.
I gave him a few weeks grace as was expecting him to come round and discuss correcting the damage (obv he never came on his own accord)
When I did speak to him about it today he tried to make out that the cracks were already there and not caused by him. Apparantly it is a coincidence that I went to work to no cracks and came home to cracks after he had spent 6 hours banging away.
He is refusing to pay to put our home right. I did mention the party wall act during a heated discussion but he still continued to refuse to pay and deny responsibility.

Where do we stand on getting our house put right and not being out of pocket in the process.

Any advice would be greatly appreciated.

Get in surveyor for professional report then sue for cost of putting right (including surveyor's costs)
 
Contact the councils building control about the removal, and then contact your insurers about the damage - you may be obligated to do this in any case

The PW Act is irrelevant now if you were not previously served a PW notice
