Permitted development close to boundary

Hi everyone,

I was just wondering what my rights are on how close I can build a small side return extension to my neighbours wall. The wall is stone and is around 1.8m high, the extension would be around 2.6m high. I was hoping to build it about 6 inch off the stone wall, I've checked and it is all within my permitted development rights size wise. Does anyone know how close I would be allowed to build it. I've spoke to my neighbour and he's against it very much even though impact will be minimal as the wall is quite high anyway! Any help would be greatly appreciated.

You should be able to build right next to it as long as you are building within your boundary. Foundations, guttering etc must also be within your boundary. You will have to ensure you do not cause any damage to the wall. Foundations are often formed in 1m long sections to reduce the chance of movement. Party wall agreement might be required with your neighbour.

Your wall must also be built in brick or maybe solid concrete blockwork. Lightweight blocks are not weatherproof unless rendered and you will not be able to render this wall.

Also be careful with PD rules as they are not as clear as you might think – by side return extension do you mean a side and rear extension? Depending on size these cannot always be built under PD

Your council should have a duty planner who is a planning officer you can go and see for free for some informal planning advice. Phone up the planning office and see what time he is there and maybe take some photos, sketches etc.

Otherwise you need to get a local architect, surveyor etc who is familiar with this type of work to come and have a look.

An architect is overkill for this use a one man band architectural technician or surveyor who does planning/regs applications.
