private/unadopted sewer collapse

I've just connected a w.c to an existing salt glazed pipe in an old property,(with the relevant building control approval)-but it looks like there is a restriction outside the property boudary,Anglian water say the drain would seem to be shared,but unadopted.Checking other threads on the forum,there is mention of the authority having to sort out shared drains if pre 1937-which this certainly is-they have been helpful so far and are sending a work unit to have a look.Any advice greatly appreciated
 
Can't help on this specifically but there are one or two learned individuals on here that may be able to ;) . But if you get no joy, try posting one of the legal forums as I’ve had some really good advice on them in the past.
 
many thanks Richard-will do as you suggest-as the reason for the connection was to do away with a dreaded macerator,looks like I'm out of the frying pan......
 
If the drain pre-dates 1st October 1937 and is shared between 2 properties or more then it will normally be a public sewer.

However, if you are the first property on the line then the pipe between your property and the main line may be private. The sewer authority will argue that it only becomes public after it passes the first junction with another property.

In cases of doubt it is standard for sewer authorities to assume the line is private and responsibility falls with the claimant to prove otherwise.

I have been involved in several of these in different parts of the country and on all occasions the sewer authority initially denied responsibility but where the cases and evidence were reasonable enough to make me pursue them they ended up doing the work.

Many thanks for the advice-the reason Anglian water gave today when they came to inspect was that the leg from the boundary to the sewer was under an unadopted road-although the road has street lighting,yellow lines,and looks like any other road,would there be a way of independantly checking this? Once again thanks for the reply

council will quickly tell you if its unadopted. normally a sign up as well
 
Your LA highways dept. will have the records. Give them the road name and grid reference (you can get that off Streetmap.com) and they'll be able to find it easily.

Checked with LA today-have to submit written request plus £35.00.Ho hum!
Still,probably need it in writing anyway if going to war with Anglian-LA would only say if there is street lighting,pavement etc to be maintained,must be adopted,but road could still belong to someone else,I see a large hole opening up in which a lot of money may have to be thrown!
 
Can't you get this info by a FOI request to the council? It may be free or £10 max if you can
