Rope around the chimney

My husband wishes to paint the outside of our house and has placed a rope around the communal chimney to support the ladder whilst he paints the eaves. Our neighbour has objected and told us that it is illegal to place a rope around the chimney and has told us to remove it. How do we stand legally do you think?

At worst he could have the chimney coming down through the roof :D I'm sure your hubby's not swinging off the ladder like a monkey but as unlikely as that may be your neighbour could theoretically throw the party wall act at you which would make it illegal as its a communal chimney on the party wall. (Legally speaking) you can't work on the party wall without a Party Wall Agreement which is basically a document signed by both parties before any works on said wall commence although in practice many people do. If your neighbour gets a leak down the chimney or and it needs a new flashing or repointing in a year they may well point the finger at you. isn't there another anchorage point he could use? Screw an eyebolt into the rafter or something? By the way working off ladders these days is a big NoNo for good reason.
