Hi
Hope someone can help. I am in the process of applying for a Certificate of Lawful Development for Existing Use. I have done an affidavit for myself which I will get sworn. My question is that I have 2 other people who can provide supporting statements - can they simply submit Statements of Truth rather than having to make them go through the hassle of getting an affidavit sworn?
Thanks

The test is balance of probabilities. Your evidence must outweigh the LPAs evidence to tip the balance. So you can't answer that question without knowing what evidence they have. My view would be that your affidavit would carry less weight than that of an unrelated third party such as a neighbour, tenant, letting agent etc.

Thanks for your reply. Their statements will state they they were the occupiers of the property and will be supporting my application. My question is can they simply submit a Statemeent of Truth in support of the CLD or do they have to submit a sworn affidavit?

There is no rule as to what you submit just that whatever it is has to outweigh anything the LPA might have. What is the issue - is it an extension or change of use? Are the LPA contesting your application?
