9.5kw shower on 32amp cartridge fuse?

Just been round to a mates house to find his shower is a 9.5kw shower on a 32amp cartridge fuse! Its on a 10mm csa cable, but 32a fuse.
How come it has not blown by now??

9.5kw roughly equates to 40A. A 30A cartridge fuse does not blow at exactly 30A, it should disconnect within 1 hour at approximately 1.45x its rating. At 40A it will take a very long time if it blows at all. It is however bad practice to overload a circuit protective device.
 
Would a 32amp MCB, RCBO be better in the same position as they don't have the heating/cooling of wired protection ( I know it should be about 45a) ?
I would suggest he changed it though.

How can in be better?

Your chosen protective device should equal to or greater than the design current, anything less and the circuit fails at design stage.
