1) If a board is actively moderated then the very fact that it is done makes the moderators liable for illegal comments. If a board is not monitored then the people who host it cannot be held responsible for what is posted there.
2) It behoves both sides of any "conversation" to take extra care over what they write, and how they read, because the normal visual and audible cues that you get when speaking to someone are missing.
Imagine you are face to face with someone, and they tell you something. You reply "Why is that, then?". Think of the number of different inflexions you could use with those words, to impart anything from humour, to incredulity, to sarcasm, to mild curiosity, to genuine interest, to outright belligerence. Yet on the page those 4 words always look the same.
When writing something, people should consider if it could be misinterpreted, and if so, explicitly explain the tone or mood it is expressing.
When reading, people should not tend to the view that anybody who asks them a question about something they have said is challenging them.
