1. that employer has carried out a suitable and sufficient assessment as to whether asbestos, what type of asbestos, contained in what material and in what condition is present or is liable to be present in those premises;

CDM does apply to domestic work, and does invoke asbestos regulations and other safety legislation generally.What is the purpose of this legislation?
The Control of Asbestos Regulations provide a framework for the management of asbestos/asbestos containing materials (ACMs) in existing non-domestic premises and during any work activity involving asbestos. Dutyholders must make sure anyone who carries out any work in non-domestic premises and any occupants of the premises are not exposed to asbestos from ACMs that may be present.
Privately owned and occupied domestic premises (e.g. houses) are specifically excluded from these regulations, however common parts of multiple occupancy domestic premises (often referred to as HMOs), such as purpose-built flats or houses converted into flats are covered. Common parts of such domestic premises might include foyers, corridors, lifts and lift shafts, staircases, roof spaces, gardens, yards, outhouses and garages, but not the private domestic area inside each flat.
Because I have not seen one, not been asked to produce one and not a single professional in the field I work with, has mentioned one. It has to be nonsense otherwise all the architects, SE's BCO's and fellow trades have been keeping me in the dark.How is it nonsense?

Also, anyone being paid to do work is an employer - even if they only employ themselves, so whilst they will not have the responsibilities for control of asbestos as a building owner, they will have all the responsibilities for working with asbestos or working in a building with asbestos.
