Alternatively, if you meant to convey that "lady" is the affected woman (who still lives in the house) and she has not taken any action but it is her husband (who no longer lives in the house) who is making the trouble, say you're happy for him to take you to court because you'd like to see what argument a person who is not experiencing any trespass can do to make a case for trespass. Like Tony said; if this couple are getting divorced, they have bigger problems than 14cm of their sky being occupied by your guttering
