There seems to be confusion as to what the position is on propping open fire doors. What I can tell you is that, under the recent Regulatory Reform Order (Fire Safety) 2005, each business must have a risk assessment. Ensuring that fire doors close properly is part of the risk assessment and the practice of propping open of fire doors would be pulled as a significant risk.
There are a number of enforcing authorities that can ensure that the recommendations in the risk assessment and inspections are adhered to using certain powers. Any findings in the inspections will result in an alterations notice, enforcement notice, or a prohibition notice. Failure to follow these notices is an offence.
Now propping open a fire door would fall under catergory 2a:
(2) It is an offence for any person to;
(a) fail to comply with article 23 (general duties of employees at work) where that failure places one or more relevant persons at risk of death or serious injury in case of fire;
And...
(5) Any person guilty of an offence under paragraph (2)(a) is liable;
(a) on summary conviction to a fine not exceeding the statutory maximum; or
(b) on conviction on indictment, to a fine.
