Is the builder or council in the wrong?

I don't quite understand the roof setup so am just gonna assume (take your word for it) the roof should have been vented.

You're on a hiding to nothing trying to get nosey and Ivor to support your stance. Yes the builder probably should have known to put a vent in but for whatever reason he didn't. BC also missed it. It happens and if it needs a vent, the builder would have to charge for it in anycase, suck it up and pay him a little more, keep him sweet if you're overall happy with his work, keep him on side, good builders seem to be like gold dust. Move on, end of thread.

Some builders will fit exactly to the spec you ask them to quote for and not query anything along the way, so if you didn't mention vents explicitly then they will not fit and won't ask either with the assumption being you know what you're asking for. Other builders will ask questions as they go rather than just plow on. Through bitter experience i've learnt that it's wise on day 1 to explain that I'm not an expert, and i could well have missed details in places, so please ask me for input on anything that I might have overlooked.
 
Nah, that's the sensible old-fashioned way.

The modern way is to assume they can read your mind and know every minor regulation off the top of their head while making the design up as they go because you haven't bothered designing it yourself or paying someone capable of doing it. Then if it doesn't turn out as you imagined, bang your fists on the floor while wailing until they do a load more work for nothing.

Everything is always someone else's fault.

It's why we have designers and architects.
 
It's not about rights or wrongs, it's about whether some battles are worth even fighting.

If the OP was to take the builder to court demanding compensation for this terrible oversight, then the court would ask for the contract and design documents. Assuming that such things don't exist, he'd be shown the door.
