surely if the builders lorry has done this, then the company is at fault, give your neighbor the companys details and tell him to take it up with them, they will have insurance for it. if the building lorry had crashed into a car on the way to your house you wouldn't be having the same conversation, its up to them not to damage things when they load / unload. you shouldn't need to be involved.
 
Its because the guy said "your builders" have done this and he will take money of me or the builders ....and i as i hired them i am liable to sort out with builders or pay for it no?

This neighbor is also not directly attached to me, its about 4-5 doors down
 
I agree.

Let him take it up with the person or company that caused the damage.

If the builder can find a way to divert responsibility onto you, let him try. Did you instruct the driver to cause the damage?

doesnt matter what he says, doesnt matter if its your builder or not, again if your builder had murdered his cat, would you be responsible because you hired him? no. your not responsible for the buildier damaging his property because you didnt ask him to damage it. the builder was neglegent and damaged it, so the builder has to pay for it, and thats if your neighbor can prove that the builder did in fact damage it. Contractors have insurance to cover this kind of thing.

if i were you, should your neighbor talk to you again, you say. "im sorry but i did not damage your property, this is the name and telephone number of the company that may have damaged your property, please take up your complaint with them, i am not liable for their negligence."

even if he took you to court he wouldn't win against you because you were not involved in the damage. wipe your hands of this one.
 
Yeah Deadbeat has it right - unless you instructed the builder to cause the damage or told him to use the service road regardless of him protesting it wasn't suitable its the builder/whoever was driving the vehicle...if the damage was even caused then..?
 
Tell them to fook right off, niggling bastards. I would say, go back to whoever built your driveway and tell them it's not fit for purpose. Is there a weight limit sign?

I would be inclined to point out the obvious fact that the builder is liable but will want proof that the concrete wasn't cracked prior.

Hi guys, random question



I have started my garage work which is a outbuilding. We have a service road at back. So my builders bought a grab lorry from the back and concrete from service road too.

What they have done is cracked one of neighbour’s concrete leading to his garage, the slope? Its probs 20cm crack and 5cm chipping.

What he is saying me or the builder will need to fix that. He also suggested there’s no way you can fix or patch a concrete and only way to fix will be to re-do the whole concrete? Is this true?

Secondly if I say I will repair the patch but not do the full thing and he denies am I legally allowed to just ignore him and let him do what he wants? Can he take me to court or anything because of my builders causing a crack on a service road? His garage is fine, but its just the slope to garage.

thanks for all your replies.... i today had another neighbour come up to me today.

He said his shutter would not open so he did all sorts and saw a damage to the shutter which he had no proof of. He said last night he got it straight...and damaged a motor.

It was apparantly damaged as he says by my builders grab lorry....

He again said same thing, he will hand the bill to me, i said give to the builders heres number but then he said he will take me to small claims court.

We did say we cant see a SINGLE dent on the garage, or even marks to prove he tried to make it straight...

I know where i live we have lot of subsidence so few garages said they had trouble opening garage doors so they had to adjust it do the the garage sinking...

but its funny its second neighbour now threatening us lol..seems like news is flying so all trying there luck....but at same time its bit scary esp after he said small claims court...
 
Let him take you to small claims court, they will just find in your favour through lack of any evidence, [and them claiming against the wrong defendant]Unless he has video of the incident?
 
No video/no cctv just witness. which i believe is other neighbor but he wont tell me the witness. But i have video of the lorry standing in front with there balance bit no where near his side(sorry not sure what those are called ) as he saying it was. so they are definitely trying it on with me.
 
yeah even if they had video it wont show you doing anything again they can take you to small claims court but they wont win, you aren't the guilty party even if there was damaged caused. just tell them to **** off.
 
Might be best not to be too rude to them if you want to live there in peace ! Have you got any more deliveries to be made up this alleyway ? Don't p*ss them off too much before you've finished ....
