I am saying that the parties to an agreement can always re negotiate, in this case on the basis of changes in viability. Ultimately the whole thing would need to be appealed if the Council didn't agree, so an inherent uncertainty.
Just going back to the thread how to move forward to re nogotiate the section 106 or remove it all togehter.
the project is a multi million pound developement and the section 106 aggrement is £151,000.
the cost of material and services (which are well documented) have risen quite dramatically. Is this a fair point to renogotiate or get it removed?
