Sorry Bahco - Been trying to get onto the forum for a few days but my profile/login was messed up.

The purpose of Police interviews are two fold.

1. To gain evidence
2. To give the defendant the opportunity to explain the facts.

I agree with what Softus says but obviously, Cops really only do it for the first reason. What may surprise you is that the majority of criminal investigators, in the majority of cases, would bypass the interview process altogether and take the case directly to the Courts if they had a choice.

However the Justice system requires the defendant to have an opportunity to be interviewed. Most defendants stick to the time honoured phrase - "No Comment". This is usually recommended by the legal rep who does this, not because it is in the interest of his client, but because he is too busy and doesn't want to hang around.

There are legal requirements that a Cop has to fulfil in some cases, such as "Special Warnings", which require defendants to account for their presence at a crime or possession of a certain item. They are told that a Jury will draw inference from their failure to answer.

I recall in the mid 1990's, University of Bristol did a survey of prosecutions in the West of England. Their conclusions were that 90% of those that admitted their guilt at interview were convicted at Court. Something like 60% who denied the offence were found guilty at Court.

Interviews do not play a large part in convictions, Juries get bored listening to hours of interviews.

Criminals who admit their guilt at an early stage WILL get discount in any sentencing, that discount usually expires at the first hearing. It's not naivety Kevplumb it's a blinking fact.

Finally, off the point I know but the bottom line is that our system favours the Criminal, but I have yet to see a better way of dealing with Justice in this Country and even though members like Gremlin and some others castigate the Old Bill I have never yet read their alternatives to the system they so despise.
