The solicitor will need to ensure who is instructing him also. If your neighbour is instructing him then he will be responsible for paying him. As others have said, you only need a surveyor, or if a dispute is deemed to arisen, two surveyors. I don't see how a solicitor can expect you to pay his fees if you haven't given him instruction to proceed.
