If the flue is very close to horizontal then the installer has fitted it in accordance with the manufacturer's instructions. So he has legally done nothing wrong.
Some of us know that its good practice to fit them pointing down by 3° but good practice is not law!
Now you are able to take the insurance company to court for breach of contract because they did not indemnify you as long as you are sure that the wording of the policy covers water damage like that.
