Raised Decking and planning permission (Ed.)

I am just seeking thoughts of others in regards to the decking my neighbours have recently replaced which is much higher than the previous decking resulting in complete lack of privacy in my garden. The children can now see straight into my garden and kitchen/living room.

The steps leading to the decking are clearly above 30cm and in close proximity to their extension. Does this require planning permission and do I have any rights with regards to loss of privacy?

Any advice would be appreciated.

I believe that anything over 300mm requires planning but it may vary from Council to Council so best bet would be to ask your Local Authority or see if their Planning Portal web site states what the rules are. Some things are now classed as Permitted Development but your Council are the ones to ask.

The 300 is a national planning edit and does not depend on the councils view. Report to council siting lost of privacy and amenity which is against national planning outlines

The 300mm is measured from the highest part of the natural ground level adjacent to the decking. If a single location meets that criteria the whole decking at that level is permitted development

So the decking will be ok then.
 
Even if it's within the 300mm rule, there are plenty of threads on this website where councils ignore this rule, and pursue homeowners for decking that is within the rules.

This may work in your favour!

I would certainly be complaining to the planning dept of the council, although I would definitely speak the neighbours first, and explain your concerns
 
Thanks Mikey, I hope it does work in my favour. The neighbour’s landlord has arranged for the decking and the neighbours won’t disclose who the landlord is. I will leave it in the hands of the planning dept at the council, I’ve submitted the form to the planning dept.
