This is what i was trying to negotiate with the planner, changing to grey/black brown but they won't have any of it.

That looks quite funky. The houses themselves are not traditional, but have a contemporary look, which IMO makes that flue fit in nicely.

If you can't argue the case now, then I would certainly refuse to amend or withdraw the app and let it go to appeal.

Have a look at the council's eco policies and how it will encourage sustainability. Then make your case on that basis, not just on the visual aspect.

Putting a chimney there would be a much worse option visually than that flue.

Have a look at what the council are doing on their own buildings to make them sustainable in terms of energy use, and look at the council housing or housing association to see what they have been fitting under recent grant work.

Ive just read sunderland council policy and they are pushing to reduce everyones carbon foot print and become eco friendly, if they make me take this down they certainly wouldn't be following this policy.
 
I'm possibly talking out of the back of my rear end, but isn't permitted development about extending a property, not about minor cosmetic changes. Is this just a case of pettiness on the part of the planning officer just because you didn't ask for permission (about something you didn't know you even had to) first. I don't know if the Hetas engineer has to apply for building control permission before they do the job (part of the reason they are registered) but if they did apply for it, then you might be able to use that against the planning officer. Have you tried talking to the jobsworths supervisor to get a more senior/alternative opinion.
