I suspect under the circumstances, that BC won't be much help now, but you could try putting in a complaint to the environment agency, as they have a duty of care to you as well as network rail. You could try environmental control at the local council, but they tend to be jobsworths and may prove useless, but you local councellor, and your MP may get things moving.

You just need to ring the local solicitors, explain the problem, and ask if they have any experience of this type of situation. They may be able to recommend someone else.

Forget building control they have no responsibility.

You could try the council's environmental health office as they have powers under the Building Act and Public Health legislation to deal with sanitation and drainage issues.

Otherwise it's a land law issue so you need a solicitor who specialises in that.

Local press? If you get a reporter on the case - "my garden's sliding onto the railway line while the bureaucrats twiddle their thumbs" might jog someone?

the ground is so saturated my property is damp, pulling 40 litres a day with a dehumidifier which constantly shows the moisture level between 80-90%. I have black mould everywhere and algae growing on the wood furniture

If you're not exagerating, that really is extraordinarily damp. I think you should concentrate on stopping the dampness getting from the waterlogged soil outside, in to the house. As I understand it the ground slopes down away from the house towards the railway over quite a long distance (150 ft?). With that layout it should be possible for the house to remain habitable, even if much of the garden is a swamp.

How old is the house? What is the construction of the walls and ground floor? Is there a cellar?
