Though what the perpetrator has done may not be against the law, their reasons for doing it are. This means it may be possible to charge them with an offence."

Reading some of it , perhaps they should turn up at most premier league foot ball grounds , they could make hundred of arrests :)

The offence of incitement to hatred occurs when someone acts in a way that is threatening and intended to stir up hatred. That could be in words, pictures, videos, music, and includes information posted on websites.
Hate content may include:

  • web pages that show pictures, videos or descriptions of violence against anyone due to their perceived differences

Criminal law with a few exceptions places more weight on the criminal mind than the criminal act. It is why for example attempted murder carries a tougher sentence than negligent killing. To that end the "hate factor" is attributed to the crime as an aggravating factor subject to sec 146 of the criminal justice act https://www.legislation.gov.uk/ukpga/2003/44/section/146

"hate incidents" are a little more complex, there is no specific statute criminalising otherwise non-criminal acts, because its a hate incident. There are however lots of bits elsewhere ranging from the Equality Act 2010, Public Order Act 1986 to the Protection from harassment act 1997. It is not really as the met article says, they have an obligation to report to build a statistical picture and they may also use other legislation, but that is not criminalising an act that isn't a criminal offence.

But if someone (anyone) believes, firmly believes, is absolutely sure in their mind that that there was a bit of prejudice or hate then that's it, you're done for.

When we are in a time of offence from an advert, a t-shirt, a doll, a tweet about a boy playing with a princess dress then we can see where this is going.

And if that text is the police interpretation and official public advice, then it's worrying.

I expect a hate crime would get a police car round immediately.
