where do you get the idea that "salaried staff CANNOT receive overtime"
They Can.

However it's not a legal obligation to pay them, but if you make an arrangement, it's fine.

"Salaried employees typically do not receive overtime pay. But a salaried employee can receive overtime pay if an agreement between him and the employer has been established; this rarely occurs. An employer is under no legal obligation to pay overtime to salaried employees."

For clarity, my salaried staff are not contractually entitled to overtime, but i am aware that other companies can and do have different arrangements.

However, in my company's case, salaried staff didn't get overtime so weren't entitled to make a retrospective holiday pay claim.

I'm not sure the argument that you had to pay your staff more for work done meant you couldn't give them such a big pay rise is a great argument.

But I do kind of agree that onerous employment rights doesn't automatically mean employees benefit.

Like minimum wage for example - if a company can't afford the cost it means less employment.
We set aside a portion of our profits each year to fund pay reviews. The reality was that we'd had a difficult couple of years and the additional provision for the retrospective holiday pay meant that we made minimal profit that year. The meant that the pot for pay reviews was much smaller.

Everyone got a smaller pay rise as a result, some got nothing. My co directors and i reduced our salaries by £10k each to help fund the rises we did pay.

Those who hadn't done much overtime or was on a salary lost out. But that was the reality of that year.

The following year, when the costs were crystallised and we knew what exactly what the ECJ ruling had cost us, the salaried staff pay review went back to normal levels, but the site engineers who accounted for the bulk of the holiday overtime claims didn't get a rate increase as they'd effectively got one through the back door. We pay a higher overtime rate than our competitors, so the new holiday pay arrangements hit us disproportionately hard and pushed the effective site engineers rates up disproportionally.

I like to think that we pay our staff well and fairly. But the reality of business is that the business can only pay what it can afford to pay if it is to stay in existence. Unfortunately, there is a perception that business owners, directors and senior managers are fat cats in it entirely for themselves and businesses can just afford to suck up whatever new regulation is applied. The reality is somewhat different.

As somebody that used to run a business, I can certainly agree with that sentiment.

it rather bugged me having to fork out nearly £1k for Sage pension modules and annual maintenance to manage the workplace pension schemes -we used nest.

and CIS -doing the monthly statements was a pain.

I do accept EU directives add pain to UK businesses, but leaving the Single Market is much bigger loss.....it will hit smaller companies hard

I can only speak for myself. I like our European friends and understand them wanting us to stay and look after their interests. But also want what is best for us.

Will you get redundancy pay?

How often are you in the A&E? I thought all your kids are grown up - or are you that old shifty bloke outside school prying on kids? You visit the drs often? That means you must have an appointment or do you just wander in to do a headcount? :ROFLMAO:

I thought you were in work? Why do you need to hang around the benefits office? Claiming on the side. :p

As to building sites - I will pop into one and do a survey. (y)
Two of my friends are ambulance drivers. In and out of A&E on a regular basis.
My wife used to work in a GP surgery.
Some of my work, up until I went on furlough in March, involved working with people connected with the social services department.
I have a friend that delivers concrete pumping machines to building sites. He often has to wait to speak to the foreman as he is usually the only one who can translate English into the native tongue of the site workers. It always baffles him how they get a CSCS card.

You asked. I told. That’s my experience. Now, how about you telling us what you do for a living, about your experience and how you know what goes on in A&E, GP's surgeries, benefits office and building sites?

Don’t suppose we'll get a sensible answer. Watch out, swerve or disappearing act coming? Place your bets!
