I thought any old or new action was down to the police and cps?

Have they not investigated previously? Was it thorough, or wasn't it?

Are you suggesting it's the Police and CPS who investigate breaches of the ministerial code?
Let me help you with that, it isn't.
 
She was and was discharged so the "conviction" was immediately spent. That means no need to declare it concerning job applications. She was not officially convicted of anything.
A conditional discharge is a conviction for the crime, without punishment. So yeah, she was actually convicted. It is true that disclosure of the conviction would be subject to the rehabilitation of offenders act, but there is a long list of exemptions to that right.
