However, the review will have no bearing on any claim he has. Expert witnesses have to be agreed or appointed. Typically one side offers a choice of 3 and the other picks.

It entirely depends on the scope of the review. Clearly procedures need to change and people at the bank need to be reminded that subject access requests can be made. Everyone should know that if you write something about someone who can make a SAR, then its not going to be confidential and you may look like a t*t.
