Yup - the evidence points to it comparing time of day as well as date. Right now some topics with a latest post of 25/6/14 are flagged, and some are not. But as we are not allowed to know the times of old posts it's not possible to accurately observe the line being crossed.

I guess that makes sense - on the basis of 'why not?'. When time is being stored, most programming languages store date-time as a single number, so, if one wants to look for "if (A-B)>1 year" I suppose one might just as well do it in terms of date-time rather than going to the trouble of just extracting the date component for the comparison.
