Then you sack them within their probation period. Net result is you sack them quicker under the new rules than the old, rather than give them the benefit of the doubt.

I wonder how that is better for the employer or the employee

Once they are passed probation - then you set them a performance target that they may find difficult if they are taking the pee with the "flexibility". Then you PIP them out. Nasty stuff.

If only there was an understanding of the need for balance under new old new labour.

Surely the working hours will be outlined in the advert / interview.

Can't see employers being happy if they recruit a "full time" worker and them then demanding flexible / part time working.

If it can't be accommodated then no, they would be correct to refuse the request. No one mentioned demanding part time working, that is completely different.

Flexible working could be full time hours over 4 days instead of five. Or a half day off during the week but make it up on a Saturday morning.

Some building trades, for one, have historically finished early on a Friday. Flexible working.
 
Strange no one mentions the period of consultation. It makes discussion about what it will entail rather difficult.
