The entire reason the case was before a court was because an athiest objected to the fact that prayers were part of the council meetings agenda. So it had EVERYTHING to do with religion. What the judge said, or what he found in his judgement is irrelevant to that.
When you appear in court whether as a witness or as the accused doesn't one have to swear on the bible,so does that mean one as to be religious to attend court if so can't a atheist refuse on religious grounds.
