Speeding fine

37 in a 30 limit.

But it could have been me or the wife, we don't remember two weeks before, 7pm, a road near home near shops etc.

It's an offence to not provide the details of the driver.
It's an offence to give the wrong name.

I've explained all that, and asked for assistance.
I've got the picture, which of course is the back of the car.
Just got the standard letter repeating that thou shallt provide details of the driver or else.
If it goes to court, I'll have to explain how I've taken all reasonable steps to determine who the driver was. If the judge accepts, then we get off.

Anyone been down this route?

You just nominate one of yourselves. The police, courts etc are not going to waste time proving your wrong. All they want is the money. After all thats whats its mainly about. Just nonimate the person who has less points already. Seems the fairest way, or toss a coin. In fact 37 in a 30 zone will mean a choice of £60 or £70 fine and points, or £80 fine and short speed awareness course but no points. So decide who will go on the course and split the fine

If the registered keeper can't supply the details - they get the fine. You know it was you anyway.

First, did they notify you (assuming that you are the registered keeper) within 14 days of the offence?

If not, or if the notice was not sent within good time to arrive at your address within the 14 days, then it is out of time and you can have it dismissed.

Second, you are duty bound under the law to make every effort to determine who was driving - but if it still proves to be impossible to say who was responsible then no-one can be prosecuted.

Neil and Christine Hamilton avoided prosecution for exactly this reason.

if I remember correctly, speed awareness courses are for first time offenders and you need to be recommended, it is not a god given right, so if either you have been done for speeding before, it rules you out.
I could be wrong though, my memory is not as it once was.

Man Up, if you don't wanna get fined, don't speed. Simples! Hope the judge throws the book at you! ;)

Our local paper always has the keeper being fined and getting the points if they fail to identify the driver who committed the offence.

They have got this one covered unfortunately with no escape route.

One of you will have to take the wrap. :(

They posted it 9 days after the event and I got it 7 days after that, which I told them in the first reply without letting on I knew about the 2 week limit. - so the dates are marginal.
Neither of us has any points.

Seems pretty dumb that they don't out the cameras in front of the marks. New cameras will be like that apparently, so they can do you for no seat belt, being on the phone, speeding, not having your tax disc the right way up, and farting without a license, to ban you in one go.

Can't believe we're the only ones who don't know what we were doing over 2 weeks ago, somebody must have been through it before.

If you HAVE to know then surely you shopuld HAVE to keep records, like companies do.
