get a digital recorder...........record several sessions..............

Then one day play them back to her..............making sure the original is elsewhere where she cant get her hands on it.

Its a big thing to claim stress because of her actions against you and the company should rightly crap itself............get the evidence.

My Brother is a factory manager...........youre in a strong position but you must get the evidence and make sure she cant get her hands on it.

Once you got it a trip to the head office is in order.

Your not allowed to record people without their knowledge.

It's perfectly ok to record a conversation you are part of without telling the other participants. I often do it if I suspect somebody will later lie and have found it extremely useful when they later do just that.

It's highly illegal to record somebody else's conversation eg phone tapping.

It's not illegal to record a conversation with another person without their consent - however said recording will not be admissable in any legal case.

Okay, what if I say "Before you speak to me I'm recording this conversation"
Then it is admissable unless the other person objects - and if it is you that objects, ask for a copy of the recording with you saying that as proof...

Likewise if you ever hear that 'calls may be recorded' message when calling a company, be sure to make the person who answers aware that you do not agree with it...

Correct. You have my sympathies ABCwarrior. Having just gone through a process of taking an a-hole to task which failed, in hindsight you are better off with the suggestion earlier from Pred of going off sick for six months and look for other work. Foreboding and a difficult option, I know, but I can tell you that the procedures do not work!

If I’d had a video camera or audio recorder I could have got the moron frog-marched off the premises! But you can’t and that’s exactly why it’s such a difficult thing to ‘out’ a moron.

If she’s like she is, is she like it with others and would those others be prepared to testify? I had witnesses to accounts of his bad behaviour and sick attitude, but he still effectively got off with a hand slap.

My case stated it should be over and done, and a conclusion reached, within 30 working days. (lmao). It took over two years, while he was redeployed, and I still to this day have nothing on paper that he will not be coming back. It’s a pyrrhic victory and the “Dignity at Work” and “Bullying and Harassment” procedures we have are not worth the paper they’re written on.

Most recently the “big cheese” came out with the ultimate political bull-sh1t line to me “we have learned lessons form it”. Well woopy f_uckin do! Life’s too short to be unhappy; whether that’s at work or in your love life.

You are captain of your own ship; master of your own destiny. You do not have to take this sh1t; there are always options even if it means hitting rock bottom and making sacrifices you never thought you could. I know; I’ve done it.

Ultimately, from my POV, I succeeded because although he didn’t get his comeuppance I got what I wanted, which is not to work with the t_wat anymore. But if I’m honest it irks me that some other poor b_uggers will have to tolerate him or, as often happens, his like are used in areas and promoted where it’s deemed ‘useful’ to have that sick attitude.

Cheers for that reply Big Tone, yeah I realise that most HR rules and regs are unenforceable bullsheet... It looks like I'm looking for another job anyway. You spend 1/3 of your life at work, more than most spend with the people you actually want to be with, so I'm not making myself ill over this by being somewhere I really don't want to be. I can most likely get a job back with my old company- yes it's 2/3 of the salary(this will rise to 4/5) and 56 miles away, and will entail getting a campervan of sorts, but I will get back to a 4 day week, a pension, a contract, paid sick leave, genuine health and safety, a constructive and creative job. At the moment it seems like I'm living to work and I'm doing nothing useful with the extra money bar P*ssing it up because the job is making me so miserable.
Will keep everyone posted, but if I leave it will be bridges well and truly burnt, something I've never done before. It'll be a very detailed description of what the job is really like and what is going on sent to the real bosses....

A 'secret' tape recording is both legal and admissible in court/tribunal as this would be a civil case. If its relevant then the judge will let it in.

However I think all this bravado from others is misplaced. You might win the case but you will get very little money and it won't be worth it. The company has larger resources and will make you suffer along the way even if they capitulate on the steps of the court. They will expect you to take that other job and only pay you the difference. If you aren't happy then get another job and don't burn your bridges because you might want to go back and you might also get an employer who wants to go back several years for references.
 
we had the recording issue at my last place of work
We could record all phone calls with out notification BUT we could not use them in a court.

Had a few people threaten us and when it was pointed out we recorded the calls the customer changed their minds knowing they was wrong. sometime took a play back off the call to assist us
 
Long story short..

Back in circa 89 I worked at a place where the manager, my immediate manager, was sacked while on annual leave. He called me and, unbeknown to me, was recording everything I said. He did the same to the MD with whom he had a quite good repoire, but it’s politics and the manager who was booted out was undermining the authority of the general manager, a close and long-standing friend of the MD.

He tried the race card, (yes he was black), but that didn’t wash because the MD’s wife was black and he was employing his, black, brother-in-law. No matter, he did end up getting a payout for wrongful dismissal, which he thought would serve them right, but he shot himself in the foot really.

The company got rid of a ‘thorn’ and although he thought the £6,000 would give them 'a bloody nose' it was peanuts to them and worth it to be rid of this 'disruptive' man.

He went on to get a job with much less pay so, as I said earlier, it’s a pyrrhic victory. The £6,000 he got was effectively more than cancelled out by the lesser earnings from the next job.

The embarrassing thing for me of course was, because he was my friend or so I thought, I basically slagged off the MD and others in my conversation. :oops:

The moral of this story? Never say something about anyone which you would not be prepared to say to their face. Advice I still don’t follow mind... :evil:

She was another Temperamental Whinging Antagonistic T_osser. If there’s such thing as a wannabe alpha-female, she was it! Born into relative wealth, spoilt to hell and incessantly boasted about it, how great she was and her pathetic exaggerated achievements.

“My husband got a pen from his mother the other day by” (can’t remember the make now). “They cost £95 you know?” Again, this was back around 1990.

Of course when you can afford to throw in the towel whenever you like you can take liberties without fear of losing your lifestyle...

Where have you read that?

As far as i know from my experience, if you are full time and not temporary they must give you a written statement of basic terms and conditions by law.
 
Hmmmm, I'm unsure as to why a secret/covert recording would be inadmissible. I think some of the ex care staff at Winterbourne View would disagree strongly (being as they are now in prison, through secret recordings) ;) ;)
 
Well today was the "SHTF" day.... I made a small mistake yesterday and she picked up on it and went mad at me when she came in to go on late shift. I calmly but loudly told her I was "f"ing sick of her attitude, and that she was far from perfect, going on to cite several occasions where she has got things wrong and nobody has childishly played the blame game but just got mucked in as a team to resolve the problems. I told her she was making my work life intolerable, and I'd had it up to here, we're a small team and should behave like one.
She was gobsmacked, I think she never thought I'd have it in me to speak back. And, in true bully fashion she backed right down. By the time I finished at 2pm she'd hugged me twice and apologised and right after the argument we walked back into the distillery, her grabbing my arm linking it like some couple.... :confused: :evil:
Oh, and the boss, who'd been in in the morning and said jack about the mistake(it was nothing serious, just a mildly overflowed tank of waste "spent lees" that needed hoovered up), was in hearing distance of it all and chose to do nothing- no intervention or breaking it up....

That's it though, no more sh*t from her, been there long enough to not have to put up with it, it was different while in training....
