I'm not a football expert, but I somehow think this wont end in a penalty shoot out.

The basis of his claim for damages:

His claim is a mix of contract, regulatory and criminal misconduct. Other than the special categories, the damages claim for defamation is really the weakest part of his claim. That is not to say its weak by any means, but there have been "serious errors of judgment" on the part of the bank and beyond the contractual breach, which is a pretty simple element, there have been some criminal offences committed.

1. Breach of contract - breach of confidentiality, failure to treat in accordance with the contract. .e.g their data privacy policy, terms of service, fairness, general bad faith etc.
2. Breach of the Data protection Act. Unlawful processing of personal data without consent, unlawful disclosure
3. Breach of Payment Account Regulations. Unlawful discrimination, notice to quit etc.
4. Defamation

Dame Alison admitted making a “serious error of judgement” in giving inaccurate information to a BBC journalist.

She had suggested Coutts’s decision to close Mr Farage’s account was because he fell under the financial threshold required to hold account, rather than because his values did not align with the bank.

She faced mounting pressure to resign over concerns she breached privacy and confidentiality rules in discussing Mr Farage’s relationship with the bank.

hard to justify good leaver status when your actions wiped £850m of the banks value. However, I suspect she has negotiated a deal. I suspect NF is also doing the same.

@JohnD, if you accept there are benefits to a Coutts account, then you must accept losing one causes damages, if you accept, having to publish nasty and prejudice material about you, to defend your reputation, you must accept these can be damaging. Lastly, simply causing someone distress and effort, is sufficient for a claim. You don't like him because of his politics. But imagine this was you -> debanked because you are a leftie. Where does it end.
