Flood - tractor driver

I still haven't seen any evidence on CCTV of smashing windows. Just a door being pushed open.

You haven't, many of us, including me, did see such videos.

The most easily found video, shows at times, something approaching a 2 foot high tidal wave, being forced against some of the shops. A 2 foot high tidal wave, hitting shops doors and windows, is certain to cause damage.

without being there...

of course she does. In her shoes I'd be arguing that the flood (which I am probably minimally insured for, if any) caused hardly any damage and the tractor (who is fully insured against accidental damage to my property) was the cause of all of it. Always best to run with an argument that someone else is at fault.

You've seen a video that shows the wave smashing a window? Not smashing against a window, not likely to cause damage to the window but actually smashing a previously un-smashed window.

Nobody is arguing that a 2 foot high "tidal wave" forcing water in to a previously dry and undamaged property would not cause damage. The specific challenge is proving it caused additional damage in value terms.
 
Plod is investigating and the driver is on bail. Plod as these sort of things are often slow.

again nobody is arguing there is not sufficient grounds to arrest for suspected [driving offences] and possible [criminal damage] and nobody is arguing that he would not be convicted if he pleaded guilty. But quite simply, people do not routinely get prosecuted for criminal damage when they cause damage to property as a result of careless or dangerous driving.

In areas where there is a risk of flood, you will need to by additional flood risk insurance for a commercial property. Very few will offer it and usually with very high excesses. Sorry you didn't know this.

I did - I saw an early video, where the corner of the tractor came into view, the tremendous bow wave, and the window shattering.
