The legislation is very clear and easy to read. I empathise with someone who wants to enjoy trolling a forum to wind up people who have opposing views. But the definition of Racial Hatred is very low and you only need to read two paragraphs of the act to get your head round it. It's not my definition. Posting something that is insulting to a race is racial hatred. But that alone does not create an offence. The offence is created when it can be established that the person had regard to the circumstances and was aware that it would stir hatred. We have established that Denso didn't clumsily post the offensive picture in the wrong thread or that he had no idea of the topic being discussed. He clearly stated the reasons and this established that he had regard to the circumstances. Its also not the first time he posted it and received complaints that it is racial hatred. You may think that bar is way too low and I might agree with you. But it's irrelevant.

So just to be clear you are saying its ok to post something that mocks Israelis and implies they play the victim card when attacked citing the holocaust as why they are victims, making light of the holocaust in doing so?
