What are they claiming and why did you ignore them for so long?

He claims an average of 63 hours a week over the past 3-4 months. So laws are being broken or he's making it up. Truck drivers are dangerous enough as it is without them working long hours.

plus it also sounds like somebody did a HIP for him and never got paid which means somebody is short for Xmas.

I'm sure it will all sort itself out in the end.

thats 10 hrs a day and a day off every other week

Not against any law whatsoever. Your thinking of the Working Time Directive, which people can opt out of if they so wish. Self Employed people too don't have to work 40 hrs a week (for many SE people 40hrs or less a week would seem like a luxury to them anyway.

I have opted out but I am still entitled to have a 11 hr continuous break in a 24 hr period,the opting out allows you to work o/t if you like.Company's don't opt out it is up to each employee.You have to renew your opt out each year, I have just done mine for next year. :LOL:

I take it work is picking up again then? :)
 
Its just that the opt out has to be renewed each year and the company must keep a record of who has and who has not and they can't be seen to discriminate against either party.
