But had he been denied entry to territorial waters and chose to enter anyway in an unsafe, unseaworthy vessel, yes he has liability.

And they know the passage is innocent without checking ?So is shooting someone with a taser or hitting them with a metal stick. But the police will do it too if you fail to comply with their lawful instructions.
The coastal state has the power to take necessary steps to prevent those who’s passage is not innocent. I’ve posted the relevant international law.
